We reserve the right to update, change, or replace any part of these Terms at our sole discretion. It is your responsibility to check this page periodically for changes. Your continued use of our website and services following the posting of any changes constitutes acceptance of those changes.

To access certain features of our services, you may be required to create an account. When creating an account, you must provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to immediately notify us of any unauthorized use of your account or any other breach of security. We will not be liable for any loss or damage arising from your failure to comply with these security obligations.

Delivery timelines provided are estimates only and may vary based on production schedules, shipping method selected, and destination. We work with third-party carriers to deliver your orders and are not liable for delays, damages, or losses that occur during shipping.

You are responsible for all shipping fees, customs duties, taxes, and other charges associated with international shipments. Risk of loss and title for products pass to you upon delivery to the carrier.

All sales are final. We offer a limited warranty against manufacturing defects only. Claims for defective products must be reported within 30 days of delivery with photographic evidence. We reserve the right to inspect returned products before authorizing any refund or replacement.

Custom packaging products are made to your specifications and cannot be returned unless they contain manufacturing defects. Design errors, color variations within industry standards, or changes in requirements after production begins are not grounds for return or refund.

A defective product is defined as one that fails to meet our published specifications due to manufacturing errors. The following are not considered defects:

• Minor color variations within industry-standard tolerances
• Slight dimensional variations within ±2mm
• Damage occurring during shipping or handling
• Normal wear and tear from use
• Issues resulting from non-compliant artwork files

For legitimate defects, our sole remedy is replacement of the defective products or refund of the purchase price, at our discretion.

You are responsible for providing print-ready artwork files that meet our specifications: CMYK color mode, minimum 300 DPI resolution, proper bleed areas, and converted text outlines. We are not responsible for print quality issues resulting from non-compliant artwork files.

While we may provide basic artwork review, final responsibility for file accuracy rests with you. Additional charges may apply for artwork modifications or corrections required to make files print-ready.

Digital proofs are provided for layout and design approval only. We are not liable for color variations between digital proofs and final printed products due to differences in monitor calibration, printing processes, and substrate materials.

For critical color matching, we recommend ordering physical color proofs or specifying Pantone colors, which may incur additional charges.

You retain ownership of all content, designs, and materials you provide to us. By submitting content, you grant Instant Custom Packaging a non-exclusive license to use, reproduce, and modify your content solely for production and fulfillment of your orders.

You may opt out of marketing use by contacting us. You warrant that your content does not infringe on third-party rights and that you have all necessary permissions. Prohibited content includes illegal, offensive, or copyrighted material used without permission.

Due to the nature of printing and manufacturing processes, we reserve the right to deliver quantities that vary by up to 10% (over or under) from your ordered quantity. Billing will be adjusted accordingly for the actual quantity delivered.

You may not use our website for any unlawful purpose or in any way that could damage, disable, or impair our services. Commercial use of our website content without written permission is prohibited. You may not attempt to gain unauthorized access to any part of our website or systems.

All content on this website, including text, graphics, logos, images, and software, is the property of Instant Custom Packaging and is protected by copyright and trademark laws. You may not reproduce, distribute, or create derivative works without our express written permission.

Our website may contain links to third-party websites. We do not endorse or control these sites and are not responsible for their content, privacy policies, or practices. Use of third-party sites is at your own risk.

You agree to use our services only for lawful purposes and in compliance with all applicable laws and regulations. You will not use our services to create products that infringe on intellectual property rights or contain illegal, offensive, or harmful content.

You agree to indemnify and hold harmless Instant Custom Packaging from any claims, damages, losses, or expenses arising from your use of our services, your content, or your violation of these Terms. This includes reasonable attorney fees and court costs.

Our services are provided "as is" without warranties of any kind, either express or implied. We disclaim all warranties, including but not limited to merchantability, fitness for a particular purpose, and non-infringement, except as expressly stated in these Terms.

We do not warrant that our services will be uninterrupted, error-free, or meet your specific requirements. Your use of our services is at your sole risk.

Our total liability for any claim arising from or related to these Terms or our services shall not exceed the amount you paid for the specific order giving rise to the claim, or $100, whichever is less.

We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, even if we have been advised of the possibility of such damages.

These Terms constitute the entire agreement between you and Instant Custom Packaging regarding your use of our services. These Terms are governed by the laws of the Province of Ontario, Canada, without regard to conflict of law principles.

Any disputes arising from these Terms shall first be addressed through good faith negotiation. If resolution cannot be reached within 30 days, disputes may be resolved through binding arbitration or the courts of Ontario, Canada.

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
